The deposit shall be returned in full to the Lessee except as provided for in Article 4 of this contract. The Lessee confirms that he\/she shall be held responsible for the rented equipment until it is returned to MIA MEDICAL ITALIA SRL, which delivery shall be certified by a receipt signed by the representative of MIA MEDICAL ITALIA SRL. The Lessee declares to reimburse MIA MEDICAL ITALIA the entire amount of any damage caused to\/to the rented equipment\/assis under this contract, by withdrawal from his credit card.<\/p>\n\n\n\n

The object of this agreement is the leasing of goods owned by M.I.A. MEDICAL ITALIA SRL (hereinafter referred to as \"The Lessor\"), which are leased under the conditions and prerequisites set forth on the first page of this agreement to the customer (hereinafter referred to as \"The Lessee\").<\/p>\n\n\n\n
The Lessee certifies that the rented item(s) is\/are delivered to him\/her in excellent condition and declares, by signing the present agreement, that he\/she has inspected it\/them and considers it\/them suitable for the intended use. The goods supplied by MIA MEDICAL ITALIA SRL have the certifications foreseen by law, which are issued by the technical offices in charge of the manufacturer of the leased orthopaedic aids for which MIA MEDICAL ITALIA SRL undertakes to supply them in perfect efficiency. It is absolutely forbidden for the Lessee to use the leased goods to persons other than the holder of this contract or other than the person subject to his parental authority or guardianship. The Lessee and\/or the Lessee shall be obliged to keep and guard the rented goods with all diligence. He is therefore obliged to reimburse M.I.A. MEDICAL ITALIA SRL for any costs related to the breakage or loss of the same, even if due to causes caused by third parties. The Lessee shall be jointly and severally liable for the rented goods. The Lessee shall be liable for damages caused during the use of the rented goods to himself, to third parties, to third parties' property, and to the rented aids themselves.<\/p>\n\n\n\n
The duration of the lease is agreed and specified on the back of this contract:
- shall be valid from the day of delivery and shall expire on the day of the return of the goods by the lessor to one of our appointees, who shall certify this by issuing a receipt to the customer;
- does not provide for any financial reimbursement and\/or credit note by M.I.A. MEDICAL ITALIA SRL in favour of the Lessee, of the sum paid by the latter, in the event of early return of the rented goods by the latter prior to the expiry date of the lease agreed upon between the parties in the present contract;<\/p>\n\n\n\n
The Lessee shall pay to the Lessor, at the time of signing the present contract, the sum of \u20ac 500,00 as security deposit\/penalty for each rented equipment, which shall be returned to the Lessee upon return of the equipment\/s, once the absence of defects or damage to the same\/s has been ascertained, if paid in cash, or automatically released at the end of the rental period if held by credit card with pre-authorisation procedure. The security deposit may be used in whole or in part to cover any damage caused during the rental period with the addition of the cost of the damage assessment if necessary. The Lessee undertakes to indemnify the Lessor for any damage resulting from the theft of the item(s) or parts thereof. Failure to pay the deposit shall result in the termination of the rental agreement for reasons attributable to the Lessee and shall entitle the Lessor to retain 20% of the amount already paid for the payment of the entire rental as a penalty.

In the event that the user does not pay the rental fee, this contract shall be considered automatically terminated and the user shall return the good(s) to the lessor, who shall retain the amounts collected as a penalty. Invoicing shall be carried out by M.I.A. MEDICAL ITALIA SRL at the end of the rental period.<\/p>\n\n\n\n
This contract is governed by Italian law. For anything not expressly provided for, the provisions of the Civil Code shall apply, and in particular the provisions of Art. 1571, Civil Code, et seq.<\/p>\n\n\n\n
In the event of disputes arising from the execution of this contract, the competent court shall have exclusive and absolute jurisdiction.<\/p>\n\n\n\n
Any amendment to this contract must be made in writing and signed by both parties under penalty of nullity.

* To use, keep and guard the hired goods with the utmost diligence.
* Pack the goods in accordance with the instructions provided
* Pay the agreed freight as indicated on the back of this contract
* Return the rented property at the end of the contract.
* To pay, in the event of damage\/damage\/theft of the item, also at the expense of third parties, the costs of repair or repurchase of the item. Any damage and\/or missing parts, etc., shall be charged to the hirer in accordance with the price table below.<\/p>\n\n\n\n

Por el inmueble arrendado, el usuario deber\u00e1 abonar al arrendatario la cantidad indicada al dorso de este contrato, cuatro d\u00edas antes de la fecha de entrega. Si no se realiza el pago, no se realizar\u00e1 la entrega.
No hay devoluci\u00f3n y\/o nota de abono del importe pagado en caso de cancelaci\u00f3n en los cuatro d\u00edas anteriores a la entrega o en caso de devoluci\u00f3n anticipada del inmueble arrendado por cualquier causa.<\/p>\n\n\n\n
El d\u00eda anterior a la entrega, enviaremos al cliente un enlace NEXI para la garant\u00eda de la ayuda, que deber\u00e1 rellenar y confirmar. Sin esto no ser\u00e1 posible entregar la ayuda solicitada. No se trata de un pago, sino de una preautorizaci\u00f3n que quedar\u00e1 congelada hasta la devoluci\u00f3n de la ayuda alquilada.

Methods of delivery and collection by home technician
Delivery by appointment with technician at home
delivery shall take place within 24 \u204448 hours from the date of receipt of the signed rental proposal for acceptance and the rental fee paid in advance.
The costs of delivery with a technician at home will be communicated to the customer on a case-by-case basis according to the requirements of the devices to be rented, as they vary according to their complexity and volume.
The collection of a device delivered by a technician at home can also be made by express courier with the prior authorisation of Mia Medicali Italia
Delivery by courier
Delivery takes place within 24 \u204448 hours after the goods have been handed over to the courier, which is subject to presentation of a certificate of payment by the customer or cash on delivery where agreed.
Transport Cost
The cost of transport is determined by the courier and is dependent on the weight and\/or volume of the package(s) hired by the customer.
Modalities of return
Mia Medical Italia , at the end of the rental period will organise the collection of the goods and the customer must make himself available for a possible appointment with a courier on an agreed date. The rented devices must be returned in the state in which they were received, fully functional and clean. UNDER PENALTY OF A CHARGE OF \u20ac 50.00.

Any extensions can be communicated by telephone or e-mail and will be settled and invoiced at the end of the rental period and the invoice for the additional expenditure will be sent by e-mail
Evasion of Orders
Mia Medical Italia, in order to guarantee a correct service to its customers, guarantees receipt and acceptance of purchase orders until 18.00 from Monday to Friday;
Upon delivery of the goods by courier, the Customer is obliged to check that the packaging is intact and not altered even in the closing tapes.
In the event of tampering and\/or breakage, the Customer shall immediately dispute the shipment and\/or delivery by affixing the word \"RESERVE FOR DAMAGED PACKAGE \"on the copy of the delivery document to be returned signed to the courier or other operator.
Guarantees
All rented products are delivered perfectly efficient, sanitised and equipped with disposable protection in the case of equipment that must come into direct contact with the skin. In the event of suspected tampering or missing packages, the goods may be accepted with specific reservation (please state the reason). The customer is obliged to report any damage within 7 days of receipt of the goods. Please note that pursuant to Legislative Decree 22\/5\/1999 no. 185, goods travel at the risk of the recipient Mia Medical Italia is not liable for any theft or damage.
After-Sales Service
Our After-Sales Department handles all types of problems that may occur from the moment the product leaves our warehouses and for the entire duration of the rental period; we handle them directly with specialised personnel who are always available to handle all possible cases.

If you cancel your booking within 4 days of the start of the rental period, you will not have to pay anything.
The rental amount MUST be paid within a maximum of 4 days from the start of the rental period.
THE HIRE WILL ONLY BE CONFIRMED ONCE THE BALANCE HAS BEEN PAID.
There is no refund for cancellations within 4 days prior to the start of the service.<\/p>\n\n\n\n
In order to deliver the aid to you, I need:

photo of the completed and signed contract
1 day before your arrival, we will send you a NEXI link for the aid guarantee, which you must fill in and sign.
